In the circumstances, the writ petition is disposed of at the admission stage directing the 1st respondent/Commissioner of Fisheries, Hyderabad, to consider representation of the petitioner for registration of the society along with all the reports sent with the said proposal and take a decision on merits and according to law as expeditiously as possible and preferably within three months from the date of communication of this order.

WRIT PETITION No.6366 of 2012

ORDER:-

 

The petitioner, who is Chief Promoter of New Fishermen Cooperative Society for Kasangod Village of Kethepally Mandal, Nalgonda District, put in representation to the Assistant Director of Fisheries, Nalgonda, in May 2009 for registration of a new society.  After conducting skill test and other field tests, Fisheries Development Officer, Nalgonda, sent his report to the Assistant Director of Fisheries, Nalgonda, on 20.11.2010.  The Assistant Director of Fisheries, Nalgonda, forwarded the said proposal to the Deputy Director of Fisheries, Nalgonda, along with letter, dated 10.12.2010.  After complying with all the objections raised by the 1st respondent/Commissioner of Fisheries, the Deputy Director of Fisheries, Kurnool, resubmitted his report to the 1st respondent/Commissioner of Fisheries in his letter, dated 25.01.2012.  It reads that skill test reports conducted on 03.01.2012 and 17.01.2012, Village Revenue Officers’ Certificate of Kasanigodu and Yendlavalli etc., were enclosed to the said report.  The petitioner is aggrieved on delay in considering registration of the proposed society by the 1st respondent/Commissioner of Fisheries.

 

2.       In the circumstances, the writ petition is disposed of at the admission stage directing the 1st respondent/Commissioner of Fisheries, Hyderabad, to consider representation of the petitioner for registration of the society along with all the reports sent with the said proposal and take a decision on merits and according to law as expeditiously as possible and preferably within three months from the date of communication of this order.
